The Airnity team would like to thank you for reading this B/OSS User Interface terms of use agreement before accessing or using the network monitoring tools accessible via the B/OSS User Interface.
These terms of use describe your rights and responsibilities when using the B/OSS User Interface, established between you and Airnity, provider of the B/OSS User Interface.
Airnity reserves the right to modify these terms of use from time to time as described in paragraph 9. This document governs your access to and use of the B/OSS User Interface and network monitoring tools provided by Airnity as well as all services related to the B/OSS User Interface, the “Service”, all of which form a contractual agreement (“Agreement”) between you (“User”) and Airnity.
The terms include conditions related to the respect of personal data as well as other attached rules as described below. If you use a (“User Account”), or are a “User” of the Service, as defined in paragraph 1 below, you acknowledge that you have understood and accepted the terms and conditions of use of the B/OSS User Interface, of the de facto Contract established between you and Airnity.
1. Definitions
The following terms used in this Agreement shall be understood according to the meanings set forth below.

“User Account” or ‘User’ represents an individual user's authorization to log in and use the Service and serves as the user's identity.

“Organization” represents the entity having a commercial contract with Airnity including access to the B/OSS User Interface.
A User Account is a member of an Organization. A User Account has a unique identifier (“Identifier”) and password.

“Service” refers to the applications, software, products and services provided by Airnity allowing to supervise and act on the lifecycle of the Organization's Airnity network subscriptions.

“Owner” refers to the members of the Organization who have the authority to define the members who will have access to the Service, and be User.

“Identity Manager” refers to the software or system implemented by the Organization and enabling it to manage and guarantee secure access to the Organization's IT tools. The integration between the Service and the Identity Manager, validated by the Organization, guarantees secure access to the Service under the Organization's sole responsibility, releasing Airnity from any liability in the event of fraudulent use of a User Account.
2. "User account"

To log in and use the Service, you must belong to an Organization that has a contract with Airnity that includes access to the B/OSS User Interface.

The Organization has control over Users and must have at least one named Owner with a valid email address within the Organization. An Organization may have several Owners The identified Owners of the Organization are responsible for the use of the Service, in particular for the actions carried out by the Users of the Organization designated by the Owners.

Rules relating to “User Accounts”:

All User Accounts must be associated with a human person; automated account creation is not permitted. A “Machine Account” is an account created by a natural person for the purpose of being used by a machine.

The Owner who creates the Machine Account accepts the conditions of Use on behalf of the Machine Account. An Identifier can only be used by one person, and therefore cannot be shared by several people.

The User is responsible for the security of his/her account while using the Service. Airnity offers integration with your organization's identity management system, which is responsible for implementing security rules such as 2-factor authentication.

The User is responsible for securing content and actions carried out from the User Account, even if these have been carried out by another individual using the User Account.

The User is responsible for securing his/her password. The User must inform Airnity immediately if he/she becomes aware of the use of the Service by a third party who is not a User, particularly if this third party has used the “User Account”. The User must inform Airnity via security-contact@airnity.com

3. User data

The User Data represents all the information and actions, of whatever nature, that the User has carried out in order to use the Service. The User and the Organization retain all rights to this information, which is entirely their property. Under the terms of this Agreement, the User and the Organization grant Airnity the non-exclusive right, without territorial limitation and free of charge, to use the data in connection with the provision of the Service.

Airnity may access User Data in response to support requests.

Airnity may compile aggregated usage statistics for the Service from User Data for reasons strictly related to improving the Service, without reference to the User's personal data.
3.1 Sensitive data

The User undertakes not to submit via the Service (A) Personal Data as defined in 3.2, except for information strictly necessary for the establishment of the Service, the User Account where applicable, (B) any information that would be in breach of a regulation in force, in particular directives relating to data protection or anti-trust regulations, depending on the territory concerned. Together, (A) + (B) constitute “Sensitive Data”.

For example, it is not permitted to submit VIN (Vehicle Identification Number) information via the Service, as this is akin to personal data.
3.2 Personal Data

“Personal Data” means any information relating to an identified or identifiable human person as defined by the General Regulation for the Protection of Personal Data (GDPR EU 2026/679 of the Council of Europe of April 27, 2016). All User Personal Data associated with the User Account are managed in accordance with current European regulations.
4. Proper use

The User of the Service shall not violate any applicable law, including copyright or trademark laws, export control or sanctions laws, or any other applicable law depending on the jurisdiction.

The User is responsible for ensuring that its use of the Service complies with all applicable laws and regulations. The User must not use the Service for any purpose other than the monitoring and maintenance in operational conditions of the Telecommunication Service as contractually defined between Airnity and the Organization.

In particular, the User must not use the Service to establish personal communications, or send messages that are personal, illegal, sexually obscene, slanderous or defamatory, fraudulent, discriminatory, threatening or harassing another person, threatening or inciting violence, glorifying violence, establishing communications aimed at disrupting the operation of connected vehicles, for example by repeated significant actions ordered from the Service.
5. Limitations on use of the Service

Under no circumstances may the user reproduce, duplicate, copy, sell, resell or exploit all or part of the Service, use of the Service or access to the Service without the express written permission of Airnity.
6. Privacy

Our privacy policy regarding personal data collected and used when using the Service is available on the “Airnity B/OSS User Interface Privacy Policy” page.

The User shall under no circumstances share data and information obtained from the Service with third parties outside the Organization. Any information shared by the User within his Organization must respect the rules in force and the confidentiality of the data according to their classification as defined by the Organization.
7. Intellectual property rights

The Applications and all information and data contained therein, its features and functionality (including, but not limited to, all information, software, text, displays, images, and the design, selection and arrangement thereof) are the property of Airnity and may not be copied, shared or resold within the Organization or to third parties under any circumstances.
8. Limitation of Liability
The User understands and agrees that Airnity shall not be liable to the User or the Organization for any loss of data or profits, or for any incidental, indirect, special or consequential damages arising out of or in connection with the Use of the Service, however caused, arising out of or in connection with:

User's use of the Service

The Service in general or the software and systems that make the Service available

Unauthorized access to or modification of data and actions transmitted by the User while using the Service

Actions carried out with the Service
9. Changes to these terms

Airnity reserves the right, at its sole discretion, to modify the Service at any time and to update these Terms of Use in the event of such modifications.

The User will be notified of material changes to this Agreement at least 30 days prior to the effective date of the change by an e-mail sent to the e-mail address of the Owner(s) designated for the User Account. Continued use of the Service after these 30 days constitutes the User's agreement with the revisions to these terms.

Airnity reserves the right, at any time and from time to time, to update the Service (or any part thereof) with or without notice.
10. Help and support

For any help or support concerning the Service, the User must use the usual means used by Airnity to support your Organization.
